Informalidad laboral en la venta por catálogo

Abstract

En esta ponencia se describe a la venta por catálogo en Argentina, como una forma de trabajo domiciliario, caracterizada por la inestabilidad, la desprotección y la inseguridad, que se desarrolla en horarios y espacios laborales variables. Se reflexiona sobre la ausencia de una ley nacional para esta forma de comercialización, que proteja a las vendedoras. Finalmente se aborda el conflicto legal por el reconocimiento del vínculo laboral entre empresas y vendedoras, divergencia que se expresa en acciones judiciales que no llegan a sentencias y que concluyen en acuerdos conciliatorios, amparados por la Ley de Contrato de Trabajo. La ponencia concluye que los y las vendedores por catálogo, pese a su rol central en el proceso de venta y distribución, son el eslabón más frágil de la cadena de valor que involucra principalmente a empresas internacionales de cosmética. La falta de reconocimiento del vínculo laboral precariza sus condiciones de trabajo y los priva de los pisos de protección social. Las conclusiones se basan en el análisis documental y en entrevistas en profundidad.
