Subjetivismo y objetivismo en la ética de los conflictos armados

Abstract

El recurso a la fuerza militar y las reglas que gobiernan los enfrentamientos durante un conflicto armado han sido objeto de una larga tradición en la reflexión jurídica y filosófica. Una de las principales divisiones contemporánea es la que se da entre los llamados tradicionalistasyrevisionistas. A los tradicionalistas se los ha identificado con el trabajo de Michael Walzer, que ha defendido una posición teórica que, en principio, refleja fielmente la regulación jurídica vigente en el derecho internacional.2 Esto significa —en lo que aquí interesa— que dado que los soldados de ambos bandos en una guerra se encuentran en una situación de imposición recíproca de riesgos, es permisible para cada uno de ellos matar a los integrantes del otro bando. Así, la implicación estándar de esta perspectiva es que los beligerantes están en una posición moralmente simétrica entre sí, pero en una posición moralmente asimétrica frente a los no combatientes. Esto se explica por el hecho de que, mientras que los soldados han perdido el derecho a la vida (son pasibles de ser atacados), los civiles no han hecho nada para perderlo. El esquema resultante, muchos dirán, captura intuiciones morales profundas, lo que a su vez explica su popularidad e influencia persistente...
