El principio de proporcionalidad y los derechos constitucionales

Abstract

El propósito del presente trabajo puede ser sintetizado en los siguientes puntos: a) exponer en qué consiste tanto el principio de proporcionalidad en sentido amplio como cada uno de los elementos que lo integran; b) llamar la atención sobre un punto relativamente poco abordado cuando se examina la proporcionalidad; a saber, que su aplicación resulta insuficiente, al menos en algunos casos, para garantizar la preeminencia de los derechos fundamentales; c) por último, puntualizar muy brevemente aquellos requisitos que debe reunir la proporcionalidad para que no ocurra lo señalado en el punto b), es decir, para que no se acabe frustrando su razón de ser, la protección de los derechos fundamentales.
