Abstract

El problema de la conducta humana, su ordenación y rectitud, su contingencia ha sido materia de estudio para muchos filósofos, juristas, teólogos, moralistas. Sin embargo, cabe poner de manifiesto que es un problema central para la vida humana sin más, es decir para el hombre, para todo hombre. El obrar humano, ordenado a fines intrínsecos, se despliega en una tensión dialéctica entre la contingencia de la libertad y la necesidad de la naturaleza. Santo Tomás de Aquino, en continuación con la milenaria tradición occidental de la que se nutre, aplica de manera original la máxima operari sequitur esse, para el caso de la ley natural y el obrar humano, pudiendo salvar los escollos del biologicismo y el positivismo moral. Su aporte, en este punto, no se limita al ámbito moral; puesto que la ley natural opera como primer principio del obrar humano, el problema se extiende al ámbito metafísico dado que la Metafísica es quien trata acerca de los principios. En su formulación de la ley natural santo Tomás pone de manifiesto la necesidad de un orden axiomático, natural y racional que impere la conducta humana. La ley natural aparece explícitamente en su obra como expresión racional del orden entitativo, pero no sólo eso, también aparece como principio de la acción humana radicalmente contingente por el hecho de su libertad.
