La trata de personas y las 100 Reglas de Brasilia: Factores por considerar en la investigación del delito en cuestión

Abstract

En el presente trabajo, nos proponemos indagar acerca de los factores que debemos tener en cuenta en las investigaciones sobre la trata de personas, enfatizando la condición de vulnerabilidad en la cual se encuentra la víctima. Aclaramos que la respuesta al crimen organizado y, en particular, a la trata de personas no puede ser únicamente represiva, pues es necesario acabar con ambas y, simultáneamente, asegurar los derechos de las víctimas. A partir de ello, nos preguntamos cuáles son las condiciones que toda investigación sobre aquel delito no puede soslayar y qué pautas nos proporcionan las 100 Reglas de Brasilia para tal efecto. Para contestar estas interrogantes, evaluaremos las diversas premisas que los distintos actores del sistema de justicia penal deben observar cuando investigan sobre el delito de trata de personas, considerando las exigencias del derecho internacional. Este estudio se desarrolla en el marco del derecho argentino y el derecho internacional -tanto hard law como soft law-, sin que ello impida que las propuestas sirvan como una fuente de derecho comparado para otros países de la región.
