El Discurso Jurídico y la Disputa por el Poder de Juzgar en un Caso con Participación de Jurados Populares

Abstract

Desde el Análisis Crítico del Discurso se considera uno de los primeros casos de juicio con jurados populares llevados a cabo en Córdoba, Argentina. Su estudio resulta relevante debido a que la acusada fue absuelta por la decisión en mayoría de jurados populares, posición contraria a la de los jueces técnicos del caso como de la jurisprudencia. En este desacuerdo se revela la disputa por el poder de juzgar entre quienes controlan el discurso jurídico (jueces técnicos y operadores jurídicos) y quienes no, encontrándose en un contexto de subordinación (jurados populares) respecto del saber jurídico. El abordaje permite mostrar que el derecho es un discurso atravesado por relaciones de poder construido sobre prácticas sociales en casos particulares que llegan a la justicia.

From a critical discourse approach, this article analyses one of the first cases of trials with popular jury conducted in Córdoba, Argentina. The case is relevant because the accused was absolved in the ruling of the trial by the decision of most of the juries, against the technical judges and the case law position. Here, the dispute for the power to judge is clearly revealed between those who control the legal discourse (technical judges and legal practitioners) and those who do not control it and are subordinate to the legal knowledge (popular jury). This analysis intents to clarify that the law is a discourse crossed by power relations built on social practices performed in the individual cases that are taken to court.
