Abstract

Los procesos concursales poseen una particular proyección social, en ellos nos encontramos con la liquidación colectiva de los bienes del deudor para hacer efectivos los créditos de sus acreedores, debido a un estado de cesación de pagos. Cada Estado regula sus situaciones concursales con más o menos particularidades, conforme a las necesidades sociales que vislumbra desde un ámbito interno o local, dado que por una cuestión de soberanía y de reconocimiento no puede darle validez a las normas más allá de sus fronteras. Pero desde algunas décadas atrás es creciente la proyección multinacional del comercio, radicándose patrimonios en distintas jurisdicciones estatales, lo cual le da el carácter de internacional. Debido a esto las situaciones falenciales al abarcar el patrimonio en su totalidad pasan a tener elementos internacionales a resolverse. Podemos entonces afirmar que estaremos ante un fenómeno de quiebra internacional si nos encontramos frente a un patrimonio internacionalmente disperso, pero también podrá producirse la calificación de quiebra internacional ante la presencia de bienes u acreedores en distintos países...
