Abstract

El presente artículo pretende analizar, desde una perspectiva jurídica y politológica, el diseño institucional y los resultados de la aplicación empírica de la revocatoria de mandato en Panamá. Este mecanismo de control de los representantes no solo ha sido incorporado en forma temprana en este país (en la Constitución de 1972) en comparación con los demás Estados latinoamericanos (los que la adoptaron lo hicieron a partir de los años 90), sino que además presenta all dos formatos: como revocatoria popular y como revocatoria partidaria, constituyendo, el segundo de ellos, una completa novedad en el continente. En este trabajo se realiza un relevamiento y estudio cronológico de la legislación nacional a través de la cual se crearon y reglamentaron estos dos institutos, así como un análisis empírico de los dos únicos casos de aplicación de revocatoria registrados hasta el momento (ambos en la modalidad partidaria). En las conclusiones se sintetizan los alcances y límites de estos mecanismos en tanto instrumentos de profundización democrática y de mejora del sistema representativo.

This article aims to analyze, from a legal and political perspective, the institutional design and the results of the empirical application of the recall in Panama. This mechanism of control of the representatives has not only been incorporated early in this country (in the 1972 Constitution) compared to the other Latin American States (those that adopted it did so from the 1990s), but also It presents two formats: as a popular recall and as a party recall, the second of them constitutes a complete novelty on the continent. In this work, therefore, we will make a chronological survey and study of the national legislation through which these two institutes were created and regulated, as well as an empirical study of the only two cases of recall application registered so far (both in party mode). The conclusions summarize the scope and limits of these mechanisms as instruments of democratic deepening and improvement of the representative system.
