Abstract

Junto con el avance de la globalización, como así también de las tecnologías de la información y comunicación, el paradigma imperante dentro del campo de los contratos se ha modificado, traspasando hoy en día las fronteras territoriales y siendo cada vez mayor el número de operaciones que se realizan de forma electrónica. Históricamente, desde los albores de la codificación civilista llevada a cabo en nuestro país por Dalmacio Vélez Sarsfield, fue la firma ológrafa la que otorgaba autenticidad a un documento y con ello preponderaba su validez jurídica. Desde ese entonces hasta la actualidad, la adopción de nuevas tecnologías para llevar a cabo diversas actividades ha producido una gran cantidad de cambios en la sociedad, situación de la cual el derecho no ha permanecido ajeno. Al día de hoy todos los países pertenecientes al Mercado Común del Sur (En adelante: MERCOSUR) cuentan con legislación sobre firma digital y la equiparan jurídicamente a la firma manuscrita.
