Abstract

El objetivo del capítulo es analizar la situación de la jurisprudencia sanjuanina sobre derechos económicos, sociales y culturales. En un primer momento, se estudia el proceso de sanción de la Constitución en 1986 y su letra. Luego se aborda la jurisprudencia de la Corte de Justicia provincial, su máximo tribunal. En la investigación se muestra cómo se pasó de la consagración generosa de DESC en la Constitución provincial a una pérdida de vigencia en la jurisprudencia.
