Abstract

El presente trabajo tiene por objetivo analizar la regulación de la actividad de las sociedades en el ámbito de los Estados Partes de Mercosur. Se parte de la premisa inicial que resulta insuficiente la normativa con la que se cuenta a nivel regional en concordancia con los objetivos que se propone MERCOSUR al momento de su creación, por lo que será necesario abordar las regulaciones en las dimensión convencional y autónoma para analizar si la normativa dentro del bloque se encuentra armonizada o no. Para ello, se consideraran las disposiciones de la Convención Interamericana sobre Conflicto de Leyes en Materia de Sociedades Mercantiles y las regulaciones en los derechos internos de cada uno de los Estados Partes.

This paper analyses the current regulatory framework governing the international activity of companies in the regional integration bloc. It deals with the two main problems of private international corporate law, the recognition of legal personality and the applicable law. In doing so, the paper analyses the issue in every dimension of private international law, with special attention to the provisions of the autonomous dimension of each of the MERCOSUR state parties, with the aim of comparing their regulations and analyzing whether a harmonization of sources within the integrated space would be advisable.
