Concepciones de salud, derecho a la salud y genética

Abstract

¿Cuáles son las obligaciones sociales del Estado para la atención pública de la salud en el estadio actual de desarrollo de la medicina y en nuestro contexto social? Para dar respuesta a esta pregunta, analizaremos la posibilidad de trazar una línea demarcatoria clara y no arbitraria quenos indique las obligaciones en salud que debe cubrir el Estado en pos de favorecer la igualdad de oportunidades frente al desafío de la ingeniería genética y frente a las crecientes desigualdades sociales que inciden en la salud en nuestra sociedad compleja. Proponemos un examen críticode los conceptos de enfermedad/salud, necesidades médicas y normalidad dados por Norman Daniels, confrontándolos con otros autores (Gert, Nussbaum y Sen). Nuestra hipótesis general consiste en sostener que toda concepción de salud, enfermedad y necesidades médicas no debe reducirse al aspecto biológico, sino que es preciso adherir a un concepto más amplio, integral y relacional de salud que resguarde el desarrollo pleno de todas las personas, protegiendo su autonomía, y planteando la intrínseca y necesaria relación entre la salud individual y la salud colectiva.
