Feminismo y penalidad como heterotopía

Abstract

Desde hace ya algunos años, estamos asistiendo a debates cada vez más extendidos en torno a las vinculaciones entre movimientos y reivindicaciones feministas y sus eventuales proyecciones específicas en el campo penal, o su formulación a través de los esquemas y lenguajes de la penalidad. Sobre este aspecto realizaba una advertencia la jurista italiana Tamar Pitch (2003) al señalar el descuido relacionado al estudio de las demandas de criminalización en general y, en particular, al uso de los lenguajes y perspectivas de la justicia penal para la articulación de demandas y formalización de conflictos, aun de manera concomitante a un cuestionamiento de la legitimidad de los sistemas de justicia. Esta contemporaneidad, marcada por la urgencia de ciertos acontecimientos, puede conducirnos a pensar esta emergencia en su pura actualidad, como una especie de saturación del presente (Caimari, 2009). Uno de los desafíos que asumimos en este Cuaderno, aunque sea de modo fragmentario, es reponer parte de los derroteros de las vinculaciones entre feminismo y penalidad, tomando como referencia una serie de textos que supusieron críticas situadas a los esquemas de aquellos estudios criminológicos que obturaban la posibilidad de indagar sobre sus aspectos sexuados. De esta manera, apostamos a integrar algunos de estos debates sobre el fondo de una temporalidad que nos precede (Didi-Huberman, 2008).
