El giro metodológico en el razonamiento judicial: El papel de las emociones

Abstract

En este trabajo sostengo que el dominio casi exclusivo de las perspectivas deontologistas y consecuencialistas sobre el razonamiento judicial viene cediendo lugar a la denominada "virtue jurisprudence". Conforme la misma, es preciso atender a las virtudes epistémicas y morales de los jueces y a cómo las mismas conducen a razonamientos prácticos correctos desde el punto de vista jurírico y/o moral. A esto se denomina aquí "giro metodológico". A este cuadro debe añadírsele un punto central: el que tiene que ver con el papel de las emociones en el razonamiento de los jueces.
