Abstract

En este capítulo nos proponemos analizar las primeras formas de institucionalización de las demandas sociales en el contexto de modernización de las instituciones estatales, retomando el ya clásico planteo de Fleury (1997) acerca de la importancia de este abordaje para el estudio de las políticas sociales en la Región Latinoamericana. Al respecto, y como describiremos en los siguientes acápites, para el período 1880-1940, encontramos que su materialización se canalizó a través de un vasto y variado conjunto de decisiones legislativas que asumieron la forma de normas legales. Muchas de esas normas se constituyeron en mediaciones en la construcción de categorías paradefinir los problemas sociales y establecer así el umbral aceptado de amenaza,degradación o riesgo que se procuraba evitar. Dichas normas dotaron de un lenguaje jurídico a las responsabilidades del Estado en torno de las formas de satisfacción de necesidades y su control, circunscribiendo de esta manera el proceso de institucionalización en el aparato estatal.
