Abstract

A apropriação pelos Estados costeiros das zonas marítimas adjacentes não constitui novidade e é prática há muito assente no direito do mar. Estas apropriações e/ ou reivindicações não foram – no entanto – semelhantes entre os Estados, registando-se, principalmente na segunda metade do século XX diferenças relevantes na natureza e extensão das reivindicações do espaço marítimo designado “mar territorial”. Estas diferenças foram ultrapassadas na III Conferência das Nações Unidas sobre Direito do Mar. A aprovação do texto final da Convenção das Nações Unidas sobre Direito do Mar, de 1982, colocou um ponto final nos limites exteriores do mar territorial ao fixar o seu limite máximo nas 12 milhas. Este capítulo refere-se a esse espaço marítimo e à Zona Contígua, e aprofunda a extensão dos direitos que o Estado costeiro exerce nestes espaços marítimos e o modo como estes direitos se relacionam com o direito de passagem inofensiva e os direitos e deveres de Estados terceiros.
