Abstract

A presente investigação desenrola-se em volta da temática do consentimento informado nos tratamentos médico-cirúrgicos, mais especificamente o consentimento dos incapazes em razão da idade e de anomalia psíquica. A obrigação de o médico obter o consentimento informado do paciente, para efectuar intervenções médicas, é relativamente recente e tem como fundamento o respeito pela vontade e autodeterminação do paciente. Estes princípios não eram tidos em consideração no momento de tomar uma decisão médica, já que era o médico que decidia qual o melhor interesse do paciente, mesmo que para isso fosse necessário ocultar-lhe o verdadeiro quadro clínico. Esta situação transformou-se completamente e a antiga regra é agora a excepção, pois o paciente tem capacidade decisória e o poder de escolher o que pode ou não ser feito com o seu corpo. O consentimento para ser válido e eficaz tem de obedecer a alguns pressupostos como são a capacidade, a liberdade de decisão e a informação completa que permita ao paciente ficar terapeuticamente esclarecido para, deste modo, escolher qual a melhor solução para a sua situação médica. É neste sentido que surge o problema dos indivíduos incapazes, já que como não têm capacidade para consentir são necessárias formas de suprir a sua incapacidade, de modo a permitir que sejam preservados os melhores interesses destes indivíduos. This research discusses the theme of the informed consent in medical and surgical treatments, specifically the consent of incapable individuals on grounds of age and mental disorder. The obligation of the physician to obtain the informed consent, in order to perform medical interventions, is relatively recent and is based upon the respect of the will and self-determination of the patient. These principles were not taken into consideration when making a medical decision, since the doctor decided the best interests of the patient, even if, for that, he had to hide the real clinical status. This situation has completely changed and the old rule is now the exception, because the patient now has the capacity to choose what can or cannot be done with his body. For the consent to be valid and effective it must fulfil certain conditions as the capacity, the freedom of decision and the complete information in order to allow the patient to be therapeutically informed, thus he could choose the best solution for the medical situation that he’s facing. In this sense, the problem with the incapable individuals, once they don’t have the capacity to consent, lies on the need to find how these individuals can express their will, so that their best interests can be protected.
