Strasburskie kryteria dotyczące izolacyjnego środka zabezpieczającego a prawo polskie

Abstract

The legal basis for the decision of the insulating safety measure are articles 93a-d and 93g of the Criminal Code. The content of the prerequisites laid down therein is based, inter alia, on the standards developed in ECHR case law. Therefore, it is important to approximate in the light of the Strasbourg case law these prerequisites, as well as the rules for this insulating security measure, including: the principle of legal certainty, no arbitrariness, court order, principle of necessity (ultima ratio), principle of proportionality, mandatory nature of objective expert opinion. Podstawę prawną orzeczenia izolacyjnego środka zabezpieczającego stanowią art. 93a-d i art. 93g k.k. Treść uregulowanych tam przesłanek opiera się między innymi na standardach wypracowanych w orzecznictwie ETPC. Dlatego też istotne jest przybliżenie w świetle orzecznictwa strasburskiego tych przesłanek, jak i zasad dotyczących izolacyjnego środka zabezpieczającego, do których zaliczyć należy: zasadę pewności prawa, zakaz arbitralności, nakaz wyrokowania przez organ sądowy, zasadę konieczności (ultima ratio), zasadę proporcjonalności i obligatoryjność obiektywnej opinii biegłych.
