Abstract

"Prawo do dobrej administracji jest jednym z podstawowych uprawnień obywatela. Uprawnienie to nie jest wyrażone wprost w zapisach prawnych ani też nie jest wyszczególnione w katalogu praw obywatelskich. Jednakże daje się je wyprowadzić w drodze dedukcji z całościowo pojmowanego porządku prawnego państwa i z zasad prawnych, które nim rządzą. Prawo to można rozpatrywać na tle fundamentalnych wymagań odnoszących się do funkcjonowania administracji publicznej państwa i podporządkowanych jej instytucji oraz jednostek organizacyjnych. Jest konsekwencją pojęcia „dobrej administracji”."(...)
