Ytringsfrihet i akademia

Abstract

Den rettslige ytringsfriheten som gjelder generelt i vårt samfunn, er gitt et enda sterkere vern i akademia. I universitets- og høyskoleloven er det bestemt at slike institusjoner skal «fremme og verne akademisk frihet». Innholdet i denne akademiske friheten, og omfanget av den, er imidlertid tema for kontinuerlig debatt. Det gjelder blant annet for spørsmål om hva det er akseptabelt å forske på, og hvilke ytringer forskere skal ha lov til å komme med. Andre eksempler er mulige virkninger av det som kalles identitetspolitikk, hvor et ønske om å beskytte svake grupper kan lede til krav om endringer i pensum eller boikott av forelesere. Mange frykter også at økt vektlegging av økonomi går på bekostning av akademisk frihet og objektivitet. Denne rapporten tar sikte på å bidra til en klargjøring av de juridiske sidene ved den akademiske ytringsfriheten. Den peker også på utviklingstrekk, usikkerheter og mulige svakheter ved noen av de reglene som praktiseres.
