Restorative Justice - konfliktmegling i fengsel

Abstract

Restorative Justice (RJ) har det samme idegrunnlaget som konfliktrådsbehandling, bl.a. ved at lovbruddet forstås som en konflikt. I det ligger det også at konflikten skal løses mellom partene, og at oppreisningen for skadelidte skal skje ved at lovbryter bidrar aktivt i oppreisningen. Samtidig vektlegger man at konflikten også angår samfunnet (lokalsamfunnet). Det kan innebære at også representanter for nærmiljø kan være part i konflikt og konfliktløsning. I en slik prosess legges det vekt på alle parter skal gi sin tilslutning til løsningen, selv om ikke alle parter alltid er like fornøyd med resultatet. Det ideelle kan man sjelden oppnå. Det vesentlige er at resultatet av meglingen blir noe alle parter aksepterer. Skal vi begynne å fokusere mer på offeret i løpet av soningen? Skal eventuelt offer og gjerningsmann møtes i fengslet? Hvem skal ”overvåke” møtet og hva blir kontaktbetjentens rolle i dette? Er det spesialister utenfra som skal drive denne formen for virksomhet? Hva slags kompetanse trenger en betjent for å kunne drive med dette? Hva blir sammenhengen med miljøarbeidet og den generelle rehabiliteringen? Hvordan skal man informere om og organisere slike møter? Mange flere spørsmål kan sikkert stilles. Vi skal prøve å behandle noe av problemområdet i denne artikkelen.
