Abstract

Norsk: Kilder må brukes i pakt med lover og regler. Det råder stor usikkerhet om hva man har lov til å kopiere og bruke i undervisning og forskning. Ot. prp. 46 (2004–2005) Om lov om endringer i åndsverkloven m.m.foreslår at opphavsrett håndteres via tre hovedformer for rettighetsavklaring. Disse er: 1. fri tilgang, 2. avtalelisens, og 3. avtalt bruk mellom opphavsperson og kildebruker. Avtalelisenser kan håndteres via digital rights management (DRM). INFOSOC-direktivet foreslår at avtalelisenser håndteres slik. Dette notatet foreslår løsninger for studenter og ansatte i universiteter og høgskoler. Ulike opphavsrettserklæringer gjennomgås. Hensikten med notatet er å øke kunnskapen om ulike former for rettighetsavklaringer av trykt og elektronisk materiale, og å stimulere til en aktiv delekultur ved bruk av utviklede læringsressurser.

English: Information sources must be used in accordance with laws and regulations. It is often difficult to define what is legal to copy, or to use in research and education. The Norwegian proposal for a new copyright law, Ot. prp. 46(2004–2005) Om lov om endringer i åndsverkloven m.m., has three main categories of copyright use: 1. open access, 2. contractual license, and 3. agreement between creator and user. The INFOSOC EU directive recommends that contractual licenses are handled through digital rights management(DRM). The aim of the paper is to increase the knowledge of use of printed and electronic sources, and to stimulate an active culture for sharing learning resources. This paper suggests solutions for students and employees in universities and university colleges. Copyright declarations are discussed.
