‘Do justice, Justice’

Abstract

Recente rechtspraak in het Europese consumentencontractenrecht laat zien dat rechtsvindingstechnieken op dit terrein van grote invloed zijn op de manier waarop het recht zich ontwikkelt. In deze bijdrage staat de ontwikkeling van adequate remedies in hypotheekuitwinningsprocedures centraal. Hoe beïnvloedt de wisselwerking tussen nationale en Europese rechters de beoordeling van dergelijke procedures? En welke rol zouden rechters in de Europese Unie moeten spelen in de evolutie van het recht in het licht van de morele beoordeling van maatschappelijke dilemma’s?
