Er bestaat geen heersende leer ten aanzien van de bewijslastverdeling onder de Hague Rules en de Hague Visby Rules. In dit artikel worden verschillende visies die naast elkaar bestaan besproken. De auteur concludeert dat een algemene regel van bewijslastverdeling niet bestaat. De bewijslast zal worden bepaald door de ingeroepen exceptie.
