Contrato realidad : factor de vulneración de acceso a los elementos del derecho fundamental al trabajo

Abstract

En Colombia las entidades públicas vinculan a través de contratos de prestación de servicios o de apoyo a la gestión a talento humano con el fin de ejecutar actividades necesarias para el funcionamiento del aparato estatal. En los últimos años la vinculación de personal mediante esta modalidad contractual ha ido en ascenso, hasta superar en algunos casos de manera exorbitante el personal de planta, constituyendo este fenómeno una posible forma de evasión estatal al deber de garantizar las condiciones de seguridad social y estabilidad laboral reconocidas por el ordenamiento jurídico nacional e internacional como elementos esenciales del derecho fundamental al trabajo digno. El presente artículo plantea los escenarios en que se mueve la contratación del recurso humano, principalmente en entidades gubernamentales y cómo esta forma de vinculación puede afectar la calidad de vida de los trabajadores.
