Abstract

El presente artículo de reflexión pretende describir los principios internacionales de la insolvencia transfronteriza reconocidos en Colombia a través de la Ley 1116 del 2006 y los contenidos en el Reglamento 1364 del 2000 emitido por la Unión Europea, bajo los parámetros de la Ley Modelo de Insolvencia Transfronteriza formulado por la Comisión de Naciones Unidas del Derecho Mercantil Internacional (CNUDMI) en el año de 1997. Aborda la flexibilidad de la ley modelo dentro del ordenamiento jurídico de Estados promulgantes, y así mismo, concentrarse en la tan buscada uniformidad y armonización en temas de Derecho Comercial Internaciona

This article aims to describe the principles reflect international recognized border insolvency in Colombia through Law 1116 of 2006 and those contained in Regulation 1346 of 2000 issued by the European Union, wthin the parameters of the Model Law on Cross-Border Insolvency formulated by the United Nations Commission on International Trade Law (UNCITRAL) in the year 1997. It addresses the flexibility of the model law within the legal system of enacting States, and also, to focus on the much sought uniformity and harmonization in international commercial law issues.
