Abstract

No solamente la libertad de elección del derecho es requisito imprescindible para garantizar la seguridad jurídica en los contratos internacionales. Para ello es necesaria también la libre elección de foro. El Convenio de la Haya sobre acuerdos de elección de foro de 30 de julio de 2005 pretende introducir esta libertad a nivel internacional. En el presente artículo analiza, tras un breve análisis de la importancia de la autonomía conflictual en el plano procesal y de elección del derecho aplicable, el contenido de dicho Convenio, destacando sus puntos fuertes y también aquellas cuestiones en las que se hace presente el llamado “conflicto de la justicia europeo-americano”, para finalmente hacer hincapié en la necesidad de su amplia ratificación.

Not only freedom of choice of law is an indispensable requisite to provide legal certainty in international contracts. Freedom of choice of jurisdiction is also necessary to achieve this goal. The Hague Convention on Choice of Court Agreements concluded on the 30th July 2005 pretends the introduction of this freedom on an international level. After a brief exposition on the importance of party autonomy on the procedural field an on the field of choice of law, the present contribution analyses the contents of the Convention pointing out its strengths and also those questions where the “European-American Justice Conflict” becomes evident. Finally, the contribution emphasizes the need for a broad ratification.
