Abstract

La figura de desaparición forzada, consagrada por primera vez en la ley 589 de 2000, se puede aplicar de forma retroactiva a hechos sucedidos los días seis y siete de noviembre de 1985, dado que entonces la conducta se encontraba tipificada a título de secuestro; este tipo de crímenes son de lesa humanidad y, por ende, son imprescriptibles. El condenado actuó como verdadero autor mediato a través de un aparato criminal organizado de poder.
