Abstract

La globalización e internacionalización de los negocios que impera en el mundo contemporáneo, exige la realización de estudios relacionados con los foros de competencia en el evento de incumplimiento de los contratos internacionales. En este sentido, el presente artículo estudia el contrato de joint-venture, como un acuerdo en virtud del cual las partes se comprometen a colaborar para desarrollar un objetivo común, desde la perspectiva de la competencia judicial para conocer de las demandas de incumplimiento, así como de la ley aplicable a los mismos. Para ello, el autor hace analiza las disposiciones contenidas en el Reglamento Comunitario 44 de 2001, los Convenios de Bruselas y de Lugano, la Ley Orgánica del Poder Judicial, el Convenio de Roma y el Código Civil Español.

Globalization and internationalization of business that prevails in the contemporary world, involves the conduct of studies related to the forums of competition in the event of a breach of international contracts. In this sense, this paper studies the joint-venture agreement as an agreement under which the parties undertake to work together to develop a common goal, from the perspective of jurisdiction to hear complaints of noncompliance and as the law applicable to them. To this end, the author examines the provisions of the Community Regulation [Resolución] 44 of 2001, the Brussels and Lugano Conventions, the Judicial Power Organization Act, the Rome Convention and the Spanish Civil Code.
