El presente trabajo tiene como objetivo principal analizar tanto las reglas generales como especiales para establecer que en el Derecho privado colombiano tiene cabida el "incumplimiento esencial" como requisito de procedencia de la acción resolutoria pretendida por uno de los contratantes frente al incumplimiento del otro, de conformidad con la regulación de la acción resolutoria que consagra el artículo 1546 del Código Civil y 870 del Código de Comercio en Colombia, centrando el análisis objeto de estudio, principalmente en la jurisprudencia de la Corte Suprema de Justicia, sin dejar de lado la doctrina y la legislación vigentes. Es un tipo de investigación dogmática que tiene como base la legislación, la doctrina y la jurisprudencia nacional y el derecho uniforme de contratos.

The main objective of this paper is to analyze both the general and special rules to establish that in Colombian private law there is room for "essential non-compliance" as a requisite of the resolution action sought by one of the contracting parties against the non-compliance of the other, conformity with the regulation of the resolutory action enshrined in article 1546 of the Civil Code and 870 of the Commercial Code in Colombia, focusing the analysis object of study, mainly in the jurisprudence of the Supreme Court of Justice, without leaving aside the doctrine and the current legislation. It is a type of dogmatic research that is based on legislation, doctrine and national jurisprudence and the uniform law of contracts.
