Abstract

La Investigación estuvo orientada a vincular las variables de responsabilidad el Estado por su obrar en la administración de justicia, derechos subjetivos y Estado de Derecho a la luz de la normativa y jurisprudencia nacional, provincial e internacional. La metodología desde un enfoque jurídico con diseño no experimental, explicativo, diacrónico, estudio de casos, legislación y doctrina. Se basó en conocer en qué medida la responsabilidad del Estado puede concebirse como instrumento de control del poder y como garantía de los ciudadanos. La evolución en el concepto de Estado, soberanía y poder público; y el papel pedagógico que supone que la Administración aprenda cómo debe actuar para evitar ser condenada. Se concluyó que el Estado tiene obligación de resarcir los daños causados por el obrar judicial. Las reformas normativas de 2014, obligan a los gobiernos locales a replantear su postura: adherirse, regularlo o guardar silencio ante la nueva legislación La Jurisprudencia nacional y provincial ha avanzado hacia una concepción amplia. En la legislación provincial, el agotamiento de la vía exigido, se ha constituido en un obstáculo al acceso a la justicia. Por lo que creemos que la CIDH condenaría al Estado santafesino si se reclamara luego de haber soportado un proceso prolongado a nivel administrativo y luego judicial. Consideramos que deberá regularse la ejecución de sentencias internacionales y que los criterios provinciales deberán evolucionar a la par del convencionalismo.

Research was aimed at linking the state variables responsibility for their work in the administration of justice, individual rights and the rule of law in the light of the legislation and national, provincial and international jurisprudence. The methodology from a legal approach with non-experimental design, explanatory, diachronic, case studies, legislation and doctrine. It was based on knowing to what extent the responsibility of the state can be conceived as an instrument of power and control as security of citizens. The evolution in the concept of state sovereignty and government; and educational role assumed that the administration learns how to act to avoid being condemned. It was concluded that the State is obliged to compensate the damage caused by judicial action. The 2014 policy reforms, require local governments to rethink their approach: stick, regulate or remain silent about the new legislation The national and provincial jurisprudence has advanced towards a broader conception. In the provincial legislation, depletion of the track required, has become an obstacle to access to justice. So we believe that the Commission condemn the Santa Fe State if claimed after having endured a lengthy administrative and judicial level then process. We believe that should be regulated enforcement of international judgments and that provincial criteria must evolve with conventionalism.
