Abstract

El propósito de la investigación ha sido fundamentar cuáles deben ser los fines del Derecho penal juvenil inherentes al modelo de la responsabilidad que decanta desde la Constitución Nacional y los tratados e instrumentos internacionales, en especial la Convención de los Derechos del Niño, abandonando la vetusta concepción tutelar de la infancia. De ese modo, se pretende justificar un Derecho penal juvenil garantista, no retributivo, preponderantemente restaurativo y excepcionalmente punitivo; sostenido sobre los dos fines antinómicos que caracterizan al Derecho penal contemporáneo: prevención especial y prevención general, ambas en sus versiones positivas y compatibles con el paradigma de los derechos humanos. Finalmente, se indaga cómo estos fines han de orientar la construcción argumentativa de la sentencia penal juvenil que decide la condena o absolución de adolescentes considerados punibles, proponiendo un modelo o esquema de resolución jurisdiccional.

The impetus for this research was to establish what the purposes of Juvenile Criminal Law should be, which are inherent to the responsibility model that favours the National Constitution and international treaties, such as the United Nations Convention on the Rights of the Child, abandoning the ancient conception of the tutelary system. Therefore, it is intended to justify a non-retributive, restorative, and exceptionally punitive Juvenile Criminal Law; dictated by the rules of the due process and based on the two antinomic objectives that characterize the contemporary Criminal Law: Special Prevention and General Prevention, both of them in their positive versions, compatible with the Human Rights. Finally, it explores how these aims should guide the argumentative construction of the sentencings for juvenile offenders, which decide whether to convict or acquit the considered-punishable teenagers, proposing a plan of a jurisdictional module.
