Ambivalencia conceptual del Derecho educativo

Abstract

La conceptualización del Derecho educativo presenta ambivalencias terminológicas que dificultan su comprensión técnica. En ocasiones, se utilizan los términos Derecho Educativo y Derecho a la Educación de formas indistintas, aunque refieran a dos categorías jurídicas diferentes. Se pretende abordar las diferencias básicas entre ambas nociones, a partir de los postulados de la normativa, la jurisprudencia y la doctrina. Se exponen los antecedentes socioculturales del Derecho Educativo, la definición y las implicaciones que el ordenamiento jurídico reconoce al Derecho Educativo (como subespecialidad jurídica objetiva) y, asimismo, al Derecho a la Educación (como derecho subjetivo fundamental). Se concluye que el régimen jurídico especializado en la Educación se denomina «Derecho Educativo», conjunto objetivo de normas, políticas públicas y principios jurídicos que regulan la generalidad de la gestión educativa. El objeto fundamental del Derecho Educativo es el Derecho a la Educación. El Derecho a la Educación presenta cuatro características fundamentales que señalan las responsabilidades de los Estados en la prestación activa del ámbito educacional: disponibilidad de centros educativos en condiciones óptimas, asequibilidad material y accesibilidad económica, aceptabilidad y pertinencia de los servicios educativos y, por último, adaptabilidad a las necesidades de los educandos y de la sociedad.
