Crime organizado: um fenómeno em adaptação e crescimento

Abstract

O conceito de crime organizado tem sofrido alterações ao longo dos tempos, e enquanto os criminologistas e os sociólogos tentam identificar as suas caraterísticas, este rapidamente passa a ter uma nova dimensão. Nos últimos dez anos, por toda a Europa, passou a utilizar-se a expressão rede criminosa como sendo a mais ajustada às especificidades deste fenómeno. Perante as variadíssimas definições e consequentes dificuldades na elaboração de um conceito de crime organizado, consideramos aqui o crité- rio conceptual adotado pela União Europeia na Decisão-Quadro 2008/841/JAI do Conselho, de 24 de outubro de 2008, relativa à luta contra a criminalidade organizada. Assim, uma organiza- ção criminosa constitui-se quando mais de duas pessoas colaboram, por um período indefinido de tempo, na prática de infracções passíveis de pena privativa de liberdade cuja duração máxima seja, pelo menos, igual ou superior a quatro anos, com objetivos lucrativos ou de poder.
