Abstract

A presente dissertação tem o intuito de analisar as garantias dos particulares no contencioso administrativo angolano, devidamente enquadradas no contencioso administrativo angolano no geral e comparadas com as garantias dos particulares no contencioso administrativo português, atenta a histórica proximidade entre os dois ordenamentos jurídicos. Faremos uma análise dos três Textos Constitucionais Angolanos (1975, 1992 e 2010), no que concerne à génese da consagração constitucional do princípio da tutela jurisdicional efectiva, princípio fulcral para a salvaguarda dos direitos e interesses dos particulares e respectivas garantias. A criação de tribunais administrativos efectivamente especializados, não de dupla especialização (administrativa e cível), será objecto do nosso estudo, porquanto tal hipótese seria muito importante para a boa administração da justiça administrativa em Angola. Concluindo, pretendemos com o presente trabalho contribuir para o melhor entendimento e eventual melhoramento do contencioso administrativo angolano, nomeadamente no que respeita à sua estrutura, à garantia dos direitos e liberdades dos particulares e aos meios processuais ao alcance daqueles para fazerem valer os seus direitos.
