Abstract

As negociações do Estatuto do Tribunal Penal Internacional (TPI) decorreram desde 1995 até meados de 1998. A criação de uma instituição com competências para julgar os indivíduos que tenham cometido crimes de “relevância internacional” esteve na base da criação do TPI. Os pontos mais polémicos deste processo negocial foram a definição dos crimes sujeitos à competência do Tribunal e a sua articulação com os tribunais nacionais, tendo sido Portugal um interveniente activo no processo, com propostas relativas à inclusão na definição de genocídio de destruição de grupo político.
