A Tributação dos novos residentes: Residentes não habituais e Programa Regressar

Abstract

Nesta dissertação procuro estudar o regime de Residência Fiscal Não Habitual e o Programa Regressar (ex residentes) num contexto nacional, procurando responder à questão sobre se estes regimes fiscais e os benefícios que a eles vem ligados vão de encontro ao objetivo do legislador. Pretendemos saber se estes regimes são potenciais promotores de um sistema fiscal mais competitivo e atrativo para estrangeiros. Também procuro ligar estes regimes à atualidade, reforçando a importância de eventos contemporâneos, como a pandemia, o aumento do teletrabalho, assim como as situações de conflito em regiões da Europa e adjacentes. Questões mais académicas, como se o Regime de Residência Não Habitual é um benefício fiscal, a eloquência e transparência do texto legislativo, a comparação com outros regimes, entre outros temas serão também foco do presente trabalho.
