The article deals with the definition of on-call duty in civil service. This is a highly practical legal problem, since on-call duty is often considered by national and EU judges as service time for which officers are entitled to pay, which has a major impact on the financial requirements of on-call duty for the security forces. The impact is so substantial that the existence of on-call duty by SWAT police units is threatened. This is a manifestation of the democratisation or humanisation of the service relationship, which, however, threatens the internal security of the Czech Republic, since it cannot afford to pay the salary of the special SWAT police officers on standby duty. Which will the administrative courts prioritise in their decisions the internal security of the state or the rights of civil servants?\n
