Magna Carta Libertatum – osmisté výročí

Abstract

The article recalls the eight hundred years anniversary of the enactment of the Magna Carta Libertatum. The author highly appreciates the historical and constitutional importance of the Magna Carta Libertatum. The study explains the origins of Magna Carta Libertatum. The article contains the analysis of the structure and general evaluation of the significance of the Magna Carta Libertatum in the development of the globalized constitutionality of contemporary states (the process of participation, negotiation, coordination and cross national constitutional impact). The author especially focuses on those aspects of constitutionality in which Magna Carta Libertatum was the first step to the further constitutional development (gradual development of parliamentarism, basic constitutional principles – Liberty,Human Rights,Democracy,Rule of Law,Due process of Law, Limited government and the concept of the state according to the Rule of Law in Continental Europe). The study explains the origins of judicial review (article 61 of the Magna Carta Libertatum).
