Abstract

[Inicio] Al igual que cualquier disposición o medida que reconozca al colectivo de trabajadores un derecho económico –de naturaleza salarial e extrasalarial–, también las mejoras y beneficios sociales asumidos unilateralmente por la empresa o pactados con su personal quedan obligados al cumplimiento del principio de igualdad y no discriminación retributiva por razón de sexo. Así se deduce de la ordenación jurídica del referido principio en la normativa vigente. Más allá de la reciente aprobación de la Directiva (UE) 2023/970, de 10 de mayo, por la que se refuerza la aplicación del principio de igualdad de retribución entre hombres y mujeres por un mismo trabajo o un trabajo de igual valor a través de medidas de transparencia retributiva y de mecanismos para su cumplimiento, baste citar, por ahora, el art. 157 TFUE y el art. 28 ET y su desarrollo reglamentario. Con todo, y pese a la importancia del aludido principio, son muy pocos los convenios colectivos que reconocen expresamente su respeto y cumplimiento, y de los que los hacen, muchos menos con expresa alusión a las partidas extrasalariales. Incluso en algunos se da por supuesto que la igualdad retributiva solo es de aplicación a las partidas salariales. Algo más positiva es la ordenación encontrada sobre esta materia en los planes de igualdad, aunque solo lo sea porque en no pocas ocasiones se limitan a reproducir literalmente el contenido del art. 28 ET.
