Abstract

Introducción. Las denominadas situaciones de crisis matrimoniales engloban la separación, el di­vorcio y la nulidad. Se regulan, respectivamente, en el Capítulo VII, Capítulo VIII y Ca­pítulo VI del Título IV del Libro Primero del Código Civil. La aprobación de la Ley 15/2005, de 8 de julio, por la que se modifican el Código Civil y la Ley de Enjuiciamiento Civil en materia de separación y divorcio, produjo una profunda reforma de la regulación de estas instituciones. Posteriormente,la Ley 15/2015, de 2 de julio, de Jurisdicción Voluntaria ha modificado ciertos aspectos, fundamental­mente formales, del régimen legal de la nulidad, separación y divorcio. Un matrimonio se considera nulo cuando existen determinadas causas legalmente tasadas que invalidan el vínculo matrimonial desde su celebración, aunque haya tenido apariencia de validez hasta la declaración de nulidad. Se considera, por tanto, que nunca ha existido legalmente. [...]
