Abstract

Introducción. La promulgación de la Ley 26/2015, de 28 de julio, de modificación del sistema de protección a la infancia y adolescencia, ha producido una reforma de la regulación de la adopción. Actualmente se contiene en la Sección segunda del Capítulo V del Título VII del Libro I del Código civil (en adelante CC), en concreto, en los arts. 175 al 180. Por otro lado, el procedimiento judicial de formalización de la adopción, ha sido modificado por la Ley 15/2015, de 2 de julio, de Jurisdicción Voluntaria. En el presente trabajo, se pretende analizar algunos de los aspectos de la actual regulación. No obstante, en primer lugar, nos parece necesario definir esta institución jurídica. El silencio del legislador al respecto ha obligado a la doctrina a su conceptualización. Así, CARRIÓN OLMOS1 considera que es “un acto judicial, por el cual se hace efectiva la voluntad de una persona o pareja de que legalmente sea hijo suyo quien no lo es por naturaleza”. De esta definición se detrae que es necesario en todo caso una resolución judicial para la constitución de la adopción, cuyos efectos son, siguiendo al mismo autor, “integrar en una familia a alguien que no pertenece a ella por razones de consanguinidad, de sangre o descendencia, creando pues un estado familiar, o, mejor, una relación de parentesco basada en el propio acto de la adopción, y por el cual se confiere a una persona un determinado estado civil de filiación”.
