En el presente trabajo se pretende realizar un análisis de una modalidad de alojamiento turístico que consiste en el arrendamiento vacacional de las viviendas habituales o partes de las mismas por parte de sus propietarios. El número creciente de turistas que, por diversas razones eligen esta opción, así como su exclusión de la Ley de Arrendamientos Urbanos 29/1994, de 24 de noviembre, ha obligado a los distintos legisladores autonómicos a su regulación, en virtud de la competencia asumida en conformidad con el artículo 148.1.18.ª de la Constitución española. Se procede al estudio comparado de la normativa territorial y a un juicio crítico de la misma, poniendo de relieve la problemática legal que supone Ja sobredimensión legislativa sobre esta materia, así como la heterogeneidad del contenido de las normas que provoca que, en función del territorio en que se ubique, su reglamentación difiera de forma notable. Esta circunstancia ha dado lugar a la existencia de diferencias significativas en los distintos aspectos como la denominación, los requisitos, la capacidad y la configuración de las viviendas, el procedimiento administrativo para el inicio de la actividad, su inscripción en el correspondiente Registro ... , causando una innecesaria confusión e inseguridad jurídica que podría solventarse mediante la promulgación de una Ley de bases que estableciese los principios mínimos exigidos.
In this pape1; the aim is to carry out an analysis of a type of tourist accommodation that consists of the vacation renta/ of the usual dwellings or parts of them by their owners. The growing number of tourists who, for various reasons, choose this option, as well as its exclusion from the Urban Leases Law 2911994, of November 24, hasforced the different regional legislators to regulate it, by virtue of the assumed competence in accordance with article 148.1.18. ª of the Constitution. We proceed to the comparative study of the territorial regulations anda critica! judgment of them, highlighting the legal problems posed by the legislative oversamension on this matter, as well as the heterogeneity of the content of the rules that causes that, depending on the territory in which it is located, its regulation differs significantly. This circumstance has given rise to the existence of significant differences in the different aspects such as the denomination, the requirements, cap acity and configuration of the dwellings, the administrative procedure for the start of the activity, its registration in the Register ... causing unnecessmy confusion and legal uncertainty that could be so/ved by enactment of a Basic L aw that establishes the mínimum principies required.
