Abstract

When there appears the feasibility of the formalization of the foster- ing of lhe nasciturus, the questions are different to bearing in mind. First, the absence of regulation expresses in the juridical classification on this supposition especially. On the other hand, the impossible observance of the protection duties that the in force legistation, of generic form, imposes any foster, in the cases in which the received one still has not born. Nevertheless, from certain doctrinal sectors there has defended itself the possible constitution of different protective measures in favour of the nasciturus - specially, the fostering-, that would acquire full efficiency after the birth of this minor, though its practical application seems to be doubtful, since it is exposed in the article,

Cuando se plantea la factibilidad de la formalización del acogimiento familiar del nasciturus, son varias las cuestiones a tener en cuenta. En primer lugar, la ausencia de regulación expresa en el ordenamiento jurídico sobre este supuesto en particular. Por otro lado, el imposible cumplimiento de los deberes de protección que la legislación vigente, de forma genérica, impone a cualquier acogedor, en los casos en los que el acogido todavía no ha nacido. No obstante, desde determinados sectores doc- trinales se ha defendido la posible constitución de distintas medidas pro- tectoras a favor del nasciturus -en especial, el acogimiento familiar, que adquirirían plena eficacia tras el nacimiento de ese menor, aunque su aplicación práctica parece dudosa, como se expone en cl artículo,
