Abstract

Introducción. El Derecho a la tutela judicial efectiva es una garantía universal que se recoge en el artículo 10 de la Declaración Universal de Derechos Humanos (DUDH) y el artículo 14 del Pacto Internacional de Derechos Civiles y Políticos. En la misma línea y en el contexto europeo, el derecho a la tutela judicial efectiva aparece plasmado en el artículo 6.1 del Convenio Europeo para la Protección de los Derechos Humanos y las Libertades Fundamentales (CEDH) y en el artículo 47 de la Carta de los Derechos Fundamentales de la Unión Europea (CDFUE). El tenor literal del artículo 6.1 del CEDH se refiere a los litigios sobre derechos y obligaciones de carácter civil o sobre el fundamento de cualquier acusación en materia penal dirigida contra un contribuyente. Cabe, por lo tanto, plantearse su aplicación a los procedimientos tributarios. Y, en este punto, diversas decisiones de la Comisión Europea y, posteriormente, varios pronunciamientos del TEDH, han interpretado restrictivamente la expresión «derechos y obligaciones de carácter civil», para responder de manera negativa a esta cuestión, utilizando como principal argumento el hecho de que el Derecho tributario es Derecho Público, mientras que la CEDH despliega sus efectos en el ámbito del Derecho Privado. Ahora bien, esta regla admitiría dos excepciones: la primera, referida a los supuestos que impliquen la determinación de derechos y obligaciones civiles; y, la segunda, los supuestos que supongan la aplicación de una carga penal contra una persona.
