Abstract

[Inicio] La globalización económica ha permitido a los grupos empresariales ampliar su ámbito de operación a todo el mundo. En este escenario, los contribuyentes pueden utilizar indebidamente los Convenios para evitar la doble imposición (CDIs) estableciendo estructuras de planificación fiscal internacional con el objeto de reducir o eliminar la carga fiscal en el Estado de la fuente. De esta manera, siendo la finalidad de la planificación fiscal internacional minimizar la carga tributaria global, puede que la reducción de la tributación en la fuente a través del empleo de los convenios no sea suficiente para lograr esa meta (ARESPACOCHAGA, 1998, p. 437). Por ello, la minoración de la carga tributaria global se conseguirá combinando de manera adecuada los CDIs y la legislación interna de los Estados. Conviene distinguir dos conductas u operaciones en las que se materializa el abuso de tratados: el treaty shopping y el rule shopping. [...]
