Abstract

En el Mundo Antiguo y, concretamente, en la civilización romana, el conubium se presentaba como una competencia jurídica exclusiva de los Estados. En la Monarquía, los matrimonios entre ciudadanos romanos fueron uniones reconocidas y legitimadas por la comunidad de Quirites. En las etapas posteriores, por la Res publica. Sin el conubium común de los contrayentes, las nupcias eran y seguían los principios del derecho de gentes1 . De acuerdo con esta posición, la naturaleza jurídica del conubium se podría situar en la órbita en la esfera del derecho internacional público y de las relaciones jurídicas internacionales privadas. El conubium regulaba y hacía justas las nupcias mixtas entre ciudadanos de diferentes nacionalidades .

In the Ancient World, and specifically in Roman civilization, the conubium was presented as an exclusive legal competence of States.
