Abstract

Introducción. Durante los últimos años no han dejado de aumentar las Decisiones de la Comisión Europea en orden al control de los regímenes de ayudas existentes en los Estados miembros, control que como no podía ser de otro modo, se extiende a las medidas fiscales y de índole financiera adoptadas por estos. Esta tendencia se justifica en la necesidad de garantizar la libre competencia en el mercado interior y encuentra cobertura en el art. 87.1 TCE -actual art. 107.1 en la versión consolidada del Tratado de Funcionamiento de la Unión Europea (en adelante TFUE)-, que establece que "serán incompatibles con el mercado interior, en la medida en que afecten a los intercambios comerciales entre Estados miembros, las ayudas otorgadas por los Estados o mediante fondos estatales, bajo cualquier forma, que falseen o amenacen falsear la competencia, favoreciendo a determinadas empresas o producciones".
