Abstract

[Introducción] Cuestión recurrente en el Derecho urbanístico, más precisamente en su aplicación judicial, es la convivencia entre la ley urbanística autonómica y la ley estatal que, dictada al amparo de las competencias horizontales, como las previstas en los arts. 149.1.1 (condiciones que garanticen la igualdad básica en el ejercicio del derecho de propiedad) 149.1.18 CE (procedimiento administrativo común), incide en la materia urbanística. Un ejemplo reciente fue la STC 195/2015, de 21 de septiembre, que resuelve un RA deducido contra la STS 27 de febrero de 2014 (recurso de casación núm. 207-2011). El TS en esta sentencia confirmaba la anulación del planeamiento urbanístico de Toledo porque, a pesar de que se habían introducido cambios sustanciales en el proyecto sometido a información pública, no hubo segunda información pública.
