Abstract

Las reformas laborales de 2011 y 2012 realizaron cambios de gran calado en la negociación colectiva y, particularmente, en la sucesión de convenios, hasta el punto de que casi todas las instituciones jurídicas implicadas en este ámbito han sido objeto de modificaciones. La denuncia del convenio colectivo es una de las instituciones que menos cambios directos ha experimentado y probablemente por ello, apenas se ha prestado atención a su papel en el nuevo escenario de la negociación colectiva. Sin embargo, la reforma de otras instituciones muy cercanas a ella, como la ultraactividad, así como la revisión de la doctrina del Tribunal Supremo sobre la legitimación para denunciar, confieren a la denuncia una renovada dimensión en la negociación colectiva. A la vista de todo lo anterior, el presente artículo pretende detenerse en el análisis de esta institución, subrayando el papel protagonista que ha de asumir la autonomía colectiva para corregir ciertos desajustes a los que puede conducir la actual regulación legal.

The labor reforms of 2011 and 2012 made major changes in collective bargaining and, particularly, in the succession of agreements, to the point that almost all of the legal institutions involved in this area had been subject to modifications. The denunciation of the collective agreement is one of the institutions that has experienced the least direct changes and probably because of this, little attention has been paid to its role in the new scenario of collective bargaining. However, the reform of other institutions, such as ultra-activity, as well as the review of the Supreme Court’s doctrine on the legitimacy to denounce, confer to the denunciation to renewed dimension in collective bargaining. In view of all the above, this article intends to stop at the analysis of this institution, underlining the leading role that collective autonomy must assume to correct certain imbalances that the current legal regulation can lead to.
